1. Agreement
These Terms of Service ("Terms") govern your access to and use of Marbl3D (the "Service"): the website, game client, APIs, and related features operated by MAGKORE. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. The Service
Marbl3D is an online marble game with collectible cosmetics (skins, trails, effects, and similar items), progression, and optional online modes. The web application is hosted for production use (for example on Netlify or a similar host you configure). Accounts, profiles, and game data are stored using Supabase (hosted database and authentication). Optional real-money purchases of gem packs are processed by Stripe Checkout (cards, USD pricing shown at purchase). Online multiplayer uses a separate server that authenticates you with your account token and exchanges gameplay messages over the network.
3. Service features (overview)
Depending on release configuration, the Service may include (without limitation): solo and online play; campaign and ranked modes; inventory management and cosmetic inspection; cases and case opening; a Terminal shop for gem-based scans and purchases; a marketplace for peer-to-peer sales using in-game coins; recycling of items into coins; player trades; optional Keepsies or similar modes that exchange virtual items between players; a season pass-style reward track; leaderboards; friends and notifications; tournaments or competitive events; bug reporting; and settings including parental controls. Features may change, rotate, or be limited by region or account status.
4. Eligibility and children's privacy
You must provide a date of birth at registration. If you are under 13, you may not complete registration unless you provide a parent or guardian email address when the sign-up flow requires it (as part of our approach to U.S. children's privacy rules). Parents and guardians are responsible for minors who use the Service. Features such as parental controls in Settings may be available to restrict purchases or certain modes.
5. Accounts
You may sign up with email and password or with supported OAuth providers (currently Google and Discord). You are responsible for your credentials and for activity on your account. You may not sell, transfer, or share your account. We may suspend or terminate accounts that violate these Terms, pose a security risk, or as needed to operate or protect the Service.
6. Virtual items and currency
Skins, coins, gems, cases, keys, trails, effects, and other digital content are limited, revocable licenses to use content in the Service. They are not personal property, have no real-world monetary value, and are not redeemable for cash except where required by law. We may modify, rebalance, retire, or remove virtual items or currencies at any time.
Except where the Service expressly allows it (for example, marketplace trades for in-game coins, or player trades where implemented), you may not sell, exchange, or transfer virtual items or accounts for real money or outside the platform.
7. Cases, keys, and randomized rewards (not gambling)
7.1 Nature of the experience. Case opening and similar mechanics provide randomized cosmetic items for use inside Marbl3D only. They are intended as entertainment, similar to collectible products in other online games. They are not gambling: you do not wager real money on unknown outcomes for a cash prize, and virtual items cannot be cashed out through us.
7.2 No purchase of cases with gems or real money (direct path). In the current product design, gems and real-money payments are not used to buy or open cases. Season cases are obtained using in-game coins only where that path is enabled. Match-drop cases may be earned from gameplay; opening certain match-drop cases may require spending in-game coins on keys or related costs as shown in the Service (for example, a fixed coin price per key).
7.3 Odds and information. Before you open a case, the Service is designed so you can inspect the possible contents and see rarity odds (percentages) in the case inspection experience. A pity system may apply—for example, if you go a defined number of opens without receiving Epic-tier or higher rewards, a subsequent open may guarantee a minimum rarity as disclosed in the UI. Exact numbers and labels are shown in-game and may be tuned for balance.
7.4 Independent outcomes. Openings use the probabilities and rules described in the Service. Past results do not change the odds of future opens except where an explicit pity or similar rule states otherwise.
7.5 Regional rules. Some countries or regions restrict or regulate paid loot boxes or randomized items. You are responsible for complying with local laws. We may modify, disable, or geo-restrict case-related features where we believe it is necessary to comply with law or platform rules.
8. Terminal shop
The Terminal may let you scan or preview items and spend gems (premium currency) before you confirm a purchase. You may decline after a scan. You choose whether to buy after you have the information shown in the Service. Gem costs, pass actions, and purchase flows are described at the point of use. Terminal purchases are for in-game cosmetics and content—not cash or anything redeemable outside the Service.
9. Marketplace, listing fees, and recycling
The marketplace lets players list and buy certain virtual items for in-game coins only. No real money is sent between players through the marketplace. Creating a listing may charge a listing fee in coins (a percentage of the list price, with a minimum), and completing a sale may charge a sale fee in coins (a percentage of the sale price), as implemented in the Service. Listings expire after the period shown in the product (for example, a limited number of days), and we may cap how many active listings you can have at once.
Recycling lets you destroy eligible items in exchange for coins at the rates shown in the Service. Recycling is optional and irreversible once confirmed where the UI states that.
10. Season pass and progression
The Service may offer a season pass or similar track: you earn season experience from play, unlock tiers, and claim rewards (which may include cases, cosmetics, or other virtual items). Pass rewards are virtual-only, subject to change between seasons, and governed by these Terms and the rules shown in-game.
11. Trades
Where player-to-player trades are available, they involve virtual items and in-Service actions only. Follow any confirmation steps and rules shown in the UI. Trades do not convert virtual items to real money through us.
12. Keepsies and wager-style modes
Optional modes may let you risk or exchange virtual items with other players. Those items have no real-world value, and no real money is wagered or paid out through these modes. You must opt in where the Service requires it. Parental controls may disable these features where we provide that option.
13. Purchases of gems (real money)
Gem packs are sold for prices shown in the Service (USD via Stripe Checkout). Payment methods and taxes follow Stripe's checkout and your location. When a purchase completes, gems are credited to your account as described in the product. As also stated near the purchase flow in the app: gems are not refundable once added to your account, except where applicable law requires otherwise or we state a different policy at checkout.
Chargebacks and payment disputes may result in suspension or reversal of credited content as permitted by law and payment network rules.
14. Multiplayer, ranked, leaderboards, and social features
Online play may expose you to other players. Leaderboards, profiles, friends, and notifications may display your username, stats, or activity as designed in the Service. You agree not to cheat, harass others, exploit bugs, or use unauthorized software. We may apply technical and account measures (including bans) to protect fair play and the multiplayer environment. Tournaments or events may have additional rules posted in the Service.
15. Prohibited conduct
- Cheating, exploiting bugs, or using unauthorized third-party tools.
- Harassment, hate speech, threats, or illegal content.
- Interfering with the Service, other users, or our infrastructure.
- Impersonation, fraud, or misrepresenting your identity or age.
- Using the marketplace, trades, or economy to launder funds, scam users, or circumvent these Terms.
- Attempting to extract real-money value from virtual items outside permitted in-Service channels.
16. User content
If you upload an avatar, choose a username, or submit bug reports or other content, you grant us a license to host and use that content to operate and improve the Service. You must have the rights to anything you submit, and your content must not violate law or these Terms.
17. Intellectual property
The Service (software, art, audio, branding, and related materials) is owned by MAGKORE or its licensors. Except for the limited rights to use the Service in accordance with these Terms, no rights are granted to you.
18. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.
19. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MAGKORE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), EXCEPT WHERE LAW DOES NOT ALLOW SUCH A LIMITATION (FOR EXAMPLE, CERTAIN CONSUMER RIGHTS IN YOUR JURISDICTION).
20. Indemnity
You agree to defend and indemnify MAGKORE against claims and expenses arising from your use of the Service, your content, or your violation of these Terms, to the extent permitted by law.
21. Changes
We may update these Terms. We will post the updated Terms and change the "Last updated" date. If changes are material, we will provide notice as required by law. Continued use after the effective date constitutes acceptance of the revised Terms.
22. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or we discontinue the Service or your account in line with our policies and applicable law.
23. Governing law and disputes
These Terms are governed by the laws of the United States and applicable federal law, without regard to conflict-of-law rules, subject to mandatory consumer protections in your country of residence (for example, EEA or UK consumer rights) where they cannot be waived. Courts in the United States may have jurisdiction over disputes, except where applicable law requires disputes to be brought in your home jurisdiction.

These Terms describe how Marbl3D is built and operated today, including randomized cosmetics and in-game economies comparable in kind to major online games. You should have qualified counsel review them for your entity, jurisdictions you serve, and launch plans.
